When you look at the website of the simplygaming.net.au, our Internet Service Provider (SimplyHost) makes a record of your visit and logs the following information for statistical purposes:

• your top level domain name (for example .com, .gov, .au, .uk etc)

• the previous site you have visited
• the type of browser you are using.

Access to information collected

Simply Gaming will not make an attempt to identify users or their browsing activities. However, in the unlikely event of an investigation, a law enforcement agency or other government agency may exercise its legal authority to inspect our Internet Service Provider's logs.

Use and disclosure of information collected

Simply Gaming will only record your e-mail address if you send us a message. Your e-mail address will only be used or disclosed for the purpose for which you have provided it and it will not be added to a mailing list or used or disclosed for any other purpose without your consent.

Simply Gaming only collect personal information that we require to conduct our business with you. We are more than happy to disclose to you how that information is stored and used by us. Your information will not be provided to any other party by us without your consent, other than as required by law.

Users are advised that there are inherent risks transmitting information across the Internet.

This website only uses session cookies and only during a search query of the website. Our Internet Service Provider has assured us that no cookies are employed on this website except for those associated with the search engine. The website statistics for this site are generated from the web logs as outlined above.

Customer Responsibilities

You are responsible for providing the Company with true and current information in regards to registration and banking/payment details. This extends to updating these details if there is a change. You are also responsible for the upkeep of your server. Including but not limited to adding mods, maps, game play related files and server configuration modifications. You may not rent or lease the server to any other individual or clan during your service term. You must ensure that your server abides by our Terms of Service at all times.
If any files, scripts or Mods, on your servers slow, crash or interrupt the service of other clients, SimplyGaming have the right to suspended or cancel your service at our discretion.

Paying for Service

All payments are due before service is rendered. A service month is 30 days; if you have paid for service for 3 months then you have 90 days of service. Service payments are expected on or before your next bill date and billing will be performed in advance. If you are unable to make your payment by the due date please submit a ticket via your client area. If you no longer require service we must be advised at the earliest possible convenience. All payments for a service term are final and will not be refunded under any circumstances. Payments made via Direct Deposite or Paypal E-Cheques, can take 5-7 days to clear, please be advised your server will not be setup until the funds have cleared. You are responsible for how you pay for your server. SimplyGaming cannot be held liable for payment comming out automatically if you have setup a subscription payment. No refund will be issued for those who simply forgot to cancel or "pressed the wrong button". This is your responsibility, not ours.

Private and Public Game Servers

Our password protected game servers (Private Server) is designed for clan use only and is not intended to be used as a public game server. Servers found without a password set will be charged as a public game hosting customer for the current billing month.
Public servers can have no password set and may freely changed from password protected to public at the Customer's discretion.

Player Limits

You are responsible for ensuring that server configuration files are not changed to enable more Game Server player slots than have been payed for. Servers found with a higher number of player slots will be charged at the current rate for slots over the allocation and the Customer will be notified of this.

Restricted Files, Mods, Plugins, etc.

We reserve the right to remove alter or deny some files that cause performance related problems with your server or any other server that may be directly affected by such files. You are responsible for payments/royalties on any extra content or modifications that require it. Files found within your directory which are prohibited and cause performatce related problems effecting but not limited to your own server, other client servers or the network on which this server is located. Your service will be terminated immediately and no refund will be paid. Further action may also be taken.

Mods, Plugins, etc.

It remains your responsibility to update and maintain all allowed mods and plugins or your server. SimplyGaming DO NOT install, update, maintain or offer support on these mods or addons.

Tag Removal

Removal of the SimplyGaming.net.au :: is only availabe to those who purchase the "Tag Removal"option at a fee of $25. Those who remove woth purchasing this option are in breach of these terms and conditions. Repeat offenders, will have there service suspended or terminated without refund at the discretion of SimplyGaming management.

FTP Access Guidelines

Server Files

FTP (File Transfer Protocol) facilities are not to be used for file storage of any kind other than those files directly required by the Customer's Game Server. All users of our service are responsible for their files and content of their servers. Game Server installs come as a basic setup. Additional files and add-ons must be applied by the customer. We are not responsible for the files in your game server directories after your game server account is activated. We strictly forbid storing of pornography, warez, or other unnecessary/Illegal files on the game server FTPs.

File Space Limits

There is a 5GB file limit per server for maps, mods, plugins, sounds etc. We reserve the right to delete information from your game install if your directory size goes over 5GB including the game install and log files. It is the Customer's responsibility to ensure these limits are not reached.

Data Security and Backups

The Customer is solely responsible for any and all backups of their Game Server data. Simply Gaming may not be held accountable for any loss of data due to hardware or software failure. We advise that the Customer keep local copies of all non-standard Game Server files such as configurations and Mods.

Refunds

Once payments have been made on servers, NO REFUNDS will be given. If you cancel your service mid-term, no refund will be given for the remainder of the term. Only time SimplyGaming will refund the amount paid, is if the service is unavailable for a period greater than 14days. Refund amount will based on a pro-rata amount. If you suddenly decide you no longer want the server for any reason, no refund will be given. As stated above refunds are only given where your service is unavailbe for an extended period of time.

Failure to Comply

Failure to comply with all current and future Terms of Service Agreements may result in termination of your account and/or service interruption without refund. We reserve the right to suspend any service if we find your server is in violation of our Terms of Service, until the account holder ensures, via the necessary changes that his/her game server complies. Billing periods will not be affected by downtime caused by account suspension.

• Free web hosting is only valid when your game server account is valid. Once the game server is terminated, web hosting will also be terminated. You do have to option to continue the web hosting at the regular price. Price's are available by visiting Simply Host
• Free web hosting is only valid for NEW server purchases. This offer does not extend to exsisting or returning clients
• Misuse of this service, will result in both web hosting and game server hosting being terminated without notice, and no refund will be issued

• If you have an existing server with Simply Gaming, the option of adding the free 11 slots to this existing server is available

• Upon the fifth successful refarral, discounts are only valid for 90 days
• Referrals are not accountable until payment is received
